Terms of Service

1. Agreement to Terms

By accessing or using EverSafe ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

EverSafe provides cloud backup services for Windows computers. The Service includes:

• Automatic file backup to secure cloud storage
• File versioning and point-in-time restore
• Client software for Windows 10 and Windows 11
• Web-based account management portal

3. User Accounts

Account Creation

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.

Encryption Password

You must create an encryption password separate from your account password. This password is used to encrypt your files. We cannot recover your encryption password or decrypt your files if you lose it. You acknowledge that losing your encryption password means permanent loss of access to your backed-up data.

Account Security

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Subscriptions and Payment

Subscription Plans

The Service is provided on a subscription basis. Subscription details, including storage limits and features, are described on our pricing page.

Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed through Stripe or PayPal. Prices are in British Pounds (GBP) and include applicable VAT.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. If you're not satisfied within 14 days of your first payment, contact us for a full refund. After 14 days, refunds are provided at our discretion.

5. Acceptable Use

You agree not to use the Service to:

• Store illegal content
• Violate any laws or regulations
• Infringe intellectual property rights
• Distribute malware or malicious software
• Attempt to gain unauthorized access to our systems
• Interfere with the Service or other users

6. Data and Privacy

Your Data

You retain all ownership rights to your data. We claim no intellectual property rights over the content you backup.

Encryption

Your data is encrypted using AES-256-GCM before leaving your device. We use zero-knowledge encryption, meaning we cannot access, read, or decrypt your files.

Data Location

Your encrypted data may be stored in data centers located in the European Union.

7. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible. We are not liable for any downtime or service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for data loss, including loss due to forgotten encryption passwords
• Our total liability is limited to the amount you paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages

9. Termination

By You

You may cancel your subscription at any time through your account dashboard. You will retain access until the end of your billing period.

By Us

We may suspend or terminate your account if you violate these Terms. In case of termination for cause, no refund will be provided.

Data After Termination

After termination, your data is retained for 30 days, during which you may reactivate your account. After 30 days, your data is permanently deleted.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
